Limits of Liability
Monterey Bay Analytical Services performs all of its services in a professional manner using generally accepted analytical methods. These methods are published by recognized sources such as the U.S. Environmental Protection Agency, the American Water Works Association, and the Water Environment Federation. In selecting Monterey Bay Analytical Services to perform analysis, our clients recognize that all samples and sampling events are unique, and that not all samples can be successfully analyzed by generally accepted methods. If analysis proves unsuccessful, the total liability of Monterey Bay Analytical Services shall not exceed the invoiced amount for the services provided. This Limit of Liability shall supersede all clauses to the contrary, implied or otherwise, in any client purchase order or contract, unless different terms are authorized in advance in writing by the director of the Laboratory.
Payment Terms
Our standard credit terms are Net 30 Days, and are independent of when clients are reimbursed. Monterey Bay Analytical Services reserves the right to require payment in advance until a credit application has been approved. A client's initial credit limit may later be increased or decreased, based upon payment history. Accounts over 30 days are subject to 1.5% per month interest. Delinquent accounts are liable for legal costs and collection agency fees incurred by Monterey Bay Analytical Services in its efforts to eliminate the overdue balance. Prices are subject to change without notice.
Holding Times
If samples are collected by the client, the client is then responsible for sampling conditions and handling. Samples should be submitted to the laboratory within the proper holding time and temperature. These times and temperatures vary for different analyses; please see the sampling guides for more information. Hold-time and temperature violations will be noted on the Chain of Custody (COC) and results may be qualified with the appropriate violation code. MBAS is not responsible for any consequences resulting from improper sampling/handling.
If samples are submitted to the laboratory after hours or on the weekends without prior arrangement, MBAS is not responsible for any hold times that may be exceeded.
Rush Analyses
Rush analyses may be available upon request at an additional charge. This must be arranged in advance and clearly indicated on the COC. If for some reason the rush time cannot be met, standard rates will apply.
Cancellations
The client may cancel analyses after sample submittal. The client will be responsible for payment of all services rendered and costs incurred up to the time of cancellation.
Special Reporting and Electronic Data Deliverables
Samples requiring Electronic Data Transfer (EDT) report submittal to the state or county must be accompanied by a completed COC that includes the system number and the source number for each sample. Please indicate on the COC that Regulatory reporting is required. Samples that are not clearly marked for Regulatory reporting and that do not have the source and system number clearly identified may not get reported or may cause unnecessary delays in the reporting process. Clients are responsible for submitting this information.
Samples requiring any other special reporting must also have a completed COC that includes all information relevant to that reporting and that indicates the particular reporting type. MBAS is not responsible for any delays caused by incomplete COCs. Please contact the laboratory prior to sampling to determine whether or not MBAS can accommodate the reporting requirements.
